As Opsa Optik Camlar Sanayi ve Ticaret Limited Şirketi ("OPSA" or the "Company"), acting as data controller under Law No. 6698 on the Protection of Personal Data (the "Law" or "KVKK"), we would like to inform you about the processing of the personal data of persons who visit the opsa.com.tr website (the "Site") and use the forms on the Site.
This notice has been prepared in accordance with Article 10 of the Law and the Communiqué on the Procedures and Principles to Be Followed in Fulfilling the Obligation to Inform. Detailed information on cookies is available on the Cookie Policy page.

Special categories of personal data: Our forms do not request special categories of personal data such as health data. Please do not write information such as your eye prescription values, prescription details or health condition in the message field. If such information needs to be shared, we will refer you to a licensed optician in your area.
3. Purposes of processing your personal data
Your personal data are processed for the following purposes:
- Receiving, assessing, answering and following up the requests, questions, suggestions and complaints you submit through the contact form,
- Assessing dealer applications and contacting the applicant,
- Providing the product, stock, technical document and point-of-sale information you request,
- Forwarding your request to the sales representative in your region,
- Ensuring the security of the Site and of our information systems; preventing spam, bot and abuse attempts,
- Fulfilling our legal obligations and responding to information requests from competent authorities and institutions,
- Only if you have given your approval/explicit consent: sending commercial electronic messages for campaign, announcement and information purposes, and performing statistical analysis of the use of the Site.
4. Legal grounds
Your personal data are processed on the basis of the following legal grounds set out in Article 5 of the Law:
- Processing is directly related to the conclusion or performance of a contract (Art. 5/2-c): assessing dealer applications; answering product, order and delivery requests,
- Processing is necessary for the data controller to fulfil its legal obligation (Art. 5/2-ç): retention and notification obligations arising from legislation,
- Processing is necessary for the establishment, exercise or protection of a right (Art. 5/2-e): use as evidence in potential disputes,
- Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject (Art. 5/2-f): answering your requests and ensuring the security of the Site,
- Explicit consent (Art. 5/1): analytics cookies and the related transfer abroad.
The sending of commercial electronic messages is based on your approval under Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages. Not giving your approval does not affect your use of the forms or the answering of your requests.
5. Method of collection
Your personal data are collected electronically, partly by automated means, through the contact and dealer application forms on the Site, the cookie preferences panel and cookies.
6. Transfer of personal data
Your personal data may be transferred, limited to the purposes above and in accordance with Articles 8 and 9 of the Law, to the following recipients:

In Türkiye:
- Service providers from which we obtain website hosting and e-mail services,
- Advisers from which we obtain legal and financial advisory services,
- Competent public authorities and institutions and judicial authorities, upon request.

- Only if you give explicit consent: Google, as the provider of the analytics service (Google Analytics) and the map service (Google Maps).

- Transfers abroad are carried out in accordance with the conditions set out in Article 9 of the Law and in the Regulation on the Procedures and Principles for the Transfer of Personal Data Abroad. The information you submit through the forms may be shared with the responsible employees at OPSA's İstanbul head office and its Ankara and İzmir branches in order to answer your request.
7. Retention period
Your personal data are retained for as long as required by the purposes of processing and for the limitation periods set out in the relevant legislation. At the end of that period, they are erased, destroyed or anonymised in accordance with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.

8. Your rights under Article 11 of the Law
With regard to your personal data, you have the right to:
- a) Learn whether your personal data are processed,
- b) Request information on the processing if your personal data have been processed,
- c) Learn the purpose of the processing of your personal data and whether they are used in accordance with that purpose,
- ç) Know the third parties in Türkiye or abroad to whom your personal data are transferred,
- d) Request the rectification of your personal data if they are incomplete or inaccurately processed,
- e) Request the erasure or destruction of your personal data within the framework of the conditions set out in Article 7 of the Law,
- f) Request that the operations carried out under subparagraphs (d) and (e) be notified to the third parties to whom your personal data have been transferred,
- g) Object to a result to your detriment arising from the analysis of the processed data exclusively by automated systems,
- ğ) Claim compensation for damage if you suffer damage as a result of the unlawful processing of your personal data.
9. How to apply
You may submit your requests concerning your rights, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, by one of the following methods:

Your applications are concluded free of charge as soon as possible, depending on the nature of the request, and within 30 days at the latest. If the process requires an additional cost, the fee set in the tariff determined by the Personal Data Protection Board may be charged.
If your application is rejected, if you find the response insufficient or if no response is given in due time, you have the right to lodge a complaint with the Personal Data Protection Board under Article 14 of the Law.
